The Supreme Court ruled on Thursday that the act designating election commissioners cannot be blocked at this time because it may cause uncertainty in the lead-up to elections.
Only a few days earlier, the Supreme Court rejected a request to stay the appointment of new election commissioners (ECs) in response to a 2023 rule that disqualified the Chief Justice of India from running for office.
The petitioners were advised by Judges Sanjiv Khanna, Dipankar Datta, and Augustine George Masih to bring a different litigation with the goal of postponing the election of ECs.
The Chief Electoral Commissioner and other Election Commissioners (Appointment, Conditions of Service and Terms of Office) Act, 2023, will not be temporarily postponed, the top court said on betway login. The court acknowledged the electoral commission’s autonomy from the “thumb of executive.”
The Supreme Court announced that it will review the primary petitions challenging the validity of the 2023 Act and asked the Center for a written response as soon as possible. Following that, the Court set August 5 for a hearing.
